An authorized party wall surveyor drafts the Party Wall Award. This is basically the situation if one surveyor is designated by each party or draft by two surveyors if separate surveyors are hired by both sides.
The Party Wall Award usually sets out the type of works to be done by the building proprietor, the decided time scale and also the method of the works to be done.
It is best practice to also prepare the Schedule of Condition record because this clearly shows that the building owner is accountable for any damages the party wall works may cause to the adjoining residence.
In an event of such situations, the Party for Award is really a point of useful resource report. This is why it is extremely essential to keep the file in a safe place. Ideally, along with the deeds to the property or home.
Party Wall Award also referred to as Party Wall Agreement is a crucial lawful record and will be very useful for any long term dispute solution.
Party Wall Agreement
Before beginning any building work associated with party walls affecting neighbours (Adjoining Proprietors), a written Party Wall Agreement is essential.
To start the process, the householder completing the building works, have to serve a written notice towards the impacted neighbours which is also known as Party Wall Notice.
As part of our key services, we provide authorised and written Party Wall Notices all over the London area.
As soon as the Party Wall Notice has been served, the neighbours have 14 days to respond. In this situation, there are 3 possible outcomes:
The neighbour provides assent meaning agree the project be carried out offering the householder will put right any issues.
In this situation, it’s best practice to appoint a surveyor to inspect and create a schedule of condition. This is to avoid any unneeded disputes at a later stage. This should be done right before beginning any developing works.
The neighbour dissents or they do not answer back within 14 days, meaning it’s presumed that they have disagreed with the proposed work.
In this situation, each party can designate their very own surveyor or even a common surveyor to issue a Party Wall Award.
The arranged surveyor needs to be impartial instead of the same surveyor the house owner might be utilizing for their own works. Otherwise, their neighbour is unlikely to see the surveyor as natural.
Each owner’s appointment their own surveyor. This can be an expensive option as the homeowner carrying out the works is responsible for the cost of both surveyors.
It is important that all these options available to the neighbours are clearly explained to the neighbours when serving the Party Wall Notice.
