What is a Party Wall Award?
A party wall award is a legal document that lays out the precise rights and responsibilities of the building owner (generally, the instigator of works to be accomplished on the party wall) and the owner of the adjoining real estate.
A licensed party wall surveyor drafts the Party Wall Award. This is basically the instance if one surveyor is appointed by all parties or draft by two surveyors if independent surveyors are designated by both sides.
The record usually sets out the kind of the works to be performed by the building proprietor, the agreed time frame along with the method of the works to be performed.
A schedule of condition is normally also prepared to show that the building owner accounts for any damage the party wall works causes towards the adjoining property.
This document works as a point of reference point if any such circumstance occurs. It is important to keep the party wall award in a safe place, preferably with the deeds to the property.
Party Wall Award also referred to as Party Wall Contract is a vital legitimate record and will be very helpful for any long term dispute resolution.
The London Party Wall Surveyor
Party Wall Agreement – The London Party Wall Surveyor
Before starting any building work with regards to party walls affecting neighbours (Adjoining Proprietors), a written Party Wall Agreement is necessary.
To begin the process, the homeowner doing the building works, must provide a written notice towards the affected neighbours that is also referred to as Party Wall Notice.
As part of our core expert services, we offer authorised and written Party Wall Notices all over the London area.
Once the Party Wall Notice has been provided, the neighbours have got 14 days to react. In this situation, there are 3 possible outcomes:
Outcome number 1:
The neighbour provides assent which means agree the project to be completed offering the homeowner will put right any concerns.
In this situation, it’s best practice to appoint a surveyor to inspect and create a schedule of condition. This is to avoid any unneeded disputes at a later phase. This needs to be done right before starting any construction works.
Outcome number 2:
The neighbour dissents or they do not respond within 14 days, which suggests it’s assumed that they have dissented.
In this case, both sides can appoint their own surveyor or even a common surveyor to issue a Party Wall Award.
The agreed surveyor must be impartial rather than exactly the same surveyor the property owner might be utilizing for their own works. Otherwise, their neighbour is unlikely to see the surveyor as neutral.
Outcome number 3:
Each owner’s appointment their own surveyor. This can be an expensive option as the homeowner carrying out the works is responsible for the cost of both surveyors.
It is important that all these options available to the neighbours are clearly explained to the neighbours when serving the Party Wall Notice.
