Details about Party Wall Awards
A party wall award is a lawful document that lays out accurate legal rights and obligations of the constructing owner (typically, the instigator of works to be performed on the party wall) and the owner of the adjacent property or home.
A qualified party wall surveyor drafts the Party Wall Award. This is actually the instance if an individual surveyor is appointed by both sides or draft by two surveyors if independent surveyors are designated by both sides.
The record precisely lays out what type of building work is completed by the building owner, the agreed-upon time frame and the method of the construction works to be performed.
A schedule of condition is often also prepared to show that the construction owner is accountable for any damages the party wall works causes towards the adjoining property or home.
This record works as a point of guide if any such scenario takes place. It is essential to keep the party wall award in a safe place, preferably with the deeds to the property.
Party Wall Award is also known as Party Wall Agreement is a vital legal record and will be very beneficial for almost any future dispute resolution.
Party Wall Agreement – The London Party Wall Surveyor
Prior to starting any construction work relating to party walls affecting neighbours (Adjacent Owners), a written Party Wall Agreement is required.
In order to commence this procedure, the property owner that is carrying out the construction work must supply a Party Wall Notice to the adjacent neighbours. This has to be served as a written notice.
As part of our core expert services, our company offers authorised and written Party Wall Notices all over the London area.
The moment the Party Wall Notice has been served, the neighbours have got 14 days to respond. In this situation, there are 3 possible outcomes:
The neighbour provides assent which means say yes to the task to be undertaken offering the homeowner will put correct any concerns.
In this situation, it’s best practice to appoint a surveyor to inspect and create a schedule of condition. This is to prevent any unneeded conflicts at a later phase. This needs to be done right before you begin any building works.
The neighbour dissents or they do not respond within 14 days, which implies it’s presumed that they have dissented.
In this situation, both sides can designate their own surveyor or even a common surveyor to issue a Party Wall Award.
The agreed-upon surveyor must be unbiased and NOT the same surveyor the homeowner might be using for their own works. Otherwise, their neighbour is unlikely to see the surveyor as natural.
Each owner’s appointment their own surveyor. This can be an expensive option as the homeowner carrying out the works is responsible for the cost of both surveyors.
It is important that all these options available to the neighbours are clearly explained to the neighbours when serving the Party Wall Notice.
