Details about Party Wall Awards
A party wall award is an authorized report that lays out specific rights and responsibilities of the building owner (generally, the instigator of works to be performed on the party wall) and the owner of the adjoining property or home.
An accredited party wall surveyor drafts the Party Wall Award. This is actually the instance if one surveyor is hired by each party or draft by two surveyors if separate surveyors are designated by both sides.
The award precisely lays out the type of building work is performed by the construction owner, the agreed timeline and also the method of the construction works to be done.
It is actually best practice also to put together the Schedule of Condition report as this clearly demonstrates that the building owner is responsible for any damage the party wall works could potentially cause towards the adjoining residence.
In an event of such situations, the Party for Award is a point of reference report. This is the reason it is extremely important to maintain the file in a safe place. Essentially, together with the deeds to the residence.
Party Wall Award also referred to as Party Wall Agreement is a vital lawful record and will be very helpful for any long term dispute solution.
Party Wall Service: Party Wall Agreement
A written Party Wall Agreement is required when starting any building works that have a party wall affecting neighbouring properties on either side.
To be able to begin this procedure, the homeowner who may be performing the construction work needs to issue a Party Wall Notice to the adjacent neighbours. This has to be delivered as a written notice.
As part of our primary services, we provide authorised and written Party Wall Notices through the entire London area.
The neighbour has 14 days to get back once the Party Wall Notice is served. Following this procedure, we now have 3 possible situations:
The neighbour provides assent which means to say yes to the project to be undertaken providing the homeowner will put right any concerns.
In this case, it’s best practice to appoint a surveyor to inspect and prepare a schedule of condition. This is to prevent any unneeded disputes at a later stage. This should be done right before you begin any building works.
The neighbour dissents or they do not answer back within 14 days, meaning it’s assumed they have disagreed with the proposed work.
If this is the situation, then all parties can appoint their very own separate Party Wall Surveyor to issue a Party Wall Award.
The arranged surveyor must be independent and NOT exactly the same surveyor the property owner might be utilizing for their own works. Otherwise, their neighbour is unlikely to see the surveyor as natural.
Each owner’s appointment their own surveyor. This can be an expensive option as the homeowner carrying out the works is responsible for the cost of both surveyors.
It is important that all these options available to the neighbours are clearly explained to the neighbours when serving the Party Wall Notice.
