The document precisely lays out what kind of work is carried out by the property owner, the decided timescale and also the method of the works to be done.
A schedule of condition is typically also prepared to show that the construction owner accounts for any damage the party wall works causes to the adjacent residence.
This document acts as a point of reference point if any such scenario takes place. It is important to keep the party wall award in a safe place, essentially with the deeds to the property.
Party Wall Award is also known as Party Wall Contract is a vital authorized document and will be very helpful for any future dispute solution.
Party Wall Service: Party Wall Agreement
Before commencing any building work in relation to party walls affecting neighbours (Adjacent Owners), a written Party Wall Agreement is necessary.
To be able to begin this procedure, the homeowner who is carrying out the development work has to issue a Party Wall Notice to the adjacent neighbours. This needs to be provided as a written notice.
We provide Party Wall Notices in the London area as part of our Party Wall Surveyor services.
Once the Party Wall Notice has been provided, the neighbours have got 14 days to react. In this situation, there are 3 possible outcomes:
The neighbour provides assent meaning say yes to the task to be carried out providing the householder will put correct any issues.
If this is the case, then simply it’s best practice to appoint a Party Wall Surveyor to prepare an independent schedule of condition. This is essential as it will prevent any possible quarrels at a later phase.
The neighbour dissents or they actually do not react within 14 days, meaning it’s presumed they have dissented.
In this situation, both sides can appoint their very own surveyor or even a common surveyor to issue a Party Wall Award.
The agreed surveyor needs to be unbiased rather than exactly the same surveyor the homeowner might be utilizing for their own works. Otherwise, their neighbour is unlikely to see the surveyor as neutral.
Each owner’s appointment their own surveyor. This can be an expensive option as the homeowner carrying out the works is responsible for the cost of both surveyors.
It is important that all these options available to the neighbours are clearly explained to the neighbours when serving the Party Wall Notice.
