Party Wall Award
A party wall award is an authorized report that lays out a accurate privileges and responsibilities of the constructing owner (typically, the instigator of works to be accomplished on the party wall) and the owner of the adjacent residence.
The party wall award is drafted by a party wall surveyor (if one surveyor is hired by both parties) or by party wall surveyors (if both sides have separate surveyors).
The document precisely lays out what type of work is done by the construction owner, the decided timeline and the manner of the works to be accomplished.
A schedule of condition is usually also prepared to demonstrate that the property owner accounts for any damage the party wall works causes towards the adjacent residence.
This document acts as a point of reference if any such situation occurs. It is important to keep the party wall award in a safe place, ideally with the deeds to the property.
Party Wall Award is also known as Party Wall Agreement is an important legal document and will be very useful for virtually every future dispute resolution.
Party Wall Agreement
A written Party Wall Contract is needed when starting any developing works that have a party wall affecting neighbouring properties on both sides.
In order to start this procedure, the property proprietor that is executing the development work must issue a Party Wall Notice to the adjoining neighbours. This has to be delivered as a written notice.
As part of our core services, we offer authorised and written Party Wall Notices throughout the entire London area.
The neighbour has got 14 days to respond once the Party Wall Notice is delivered. Following this approach, we have 3 possible outcomes:
The neighbour gives assent meaning agree the project to be carried out providing the householder will put correct any issues.
In this situation, it’s best practice to appoint a surveyor to inspect and prepare a schedule of condition. This is to avoid any unneeded disagreements at a later stage. This needs to be done right before beginning any construction works.
The neighbour dissents or they actually do not react within 14 days, meaning it’s presumed they have dissented.
In this case, both parties can appoint their very own surveyor or even a common surveyor to issue a Party Wall Award.
The agreed surveyor needs to be impartial rather than the same surveyor the house owner might be using for their own works. Otherwise, their neighbour is unlikely to view the surveyor as neutral.
Each owner’s appointment their own surveyor. This can be an expensive option as the homeowner carrying out the works is responsible for the cost of both surveyors.
It is important that all these options available to the neighbours are clearly explained to the neighbours when serving the Party Wall Notice.
