Party Wall Award
A party wall award is a legal report that lays out the accurate privileges and obligations of the constructing proprietor (typically, the instigator of works to be accomplished on the party wall) and the owner of the adjoining residence.
The party wall award is drafted by a party wall surveyor (if an individual surveyor is employed by each party) or by party wall surveyors (if both sides have separate surveyors).
The Award usually sets out the kind of the works to be carried out by the building proprietor, the decided time frame as well as the manner of the works to be accomplished.
A schedule of condition is usually also prepared to demonstrate that the construction owner is liable for any damage the party wall works causes towards the adjoining residence.
This document acts as a point of reference if any such circumstance occurs. It is essential to maintain the party wall award in a safe place, ideally with the deeds to the property.
Party Wall Award is also known as Party Wall Agreement is a crucial lawful record and will be very useful for virtually every future dispute resolution.
Party Wall Agreement – The London Party Wall Surveyor
Before starting any developing work in relation to party walls affecting neighbours (Adjacent Proprietors), a written Party Wall Agreement is essential.
In order to start this procedure, the property proprietor who may be carrying out the construction work needs to supply a Party Wall Notice to the adjoining neighbours. This has to be delivered as a written notice.
As part of our primary expert services, we provide authorised and written Party Wall Notices all over the London area.
The neighbour has got 14 days to respond once the Party Wall Notice is provided. After this procedure, we now have 3 possible outcomes:
The neighbour gives assent meaning accept the work to be undertaken providing the householder will put correct any problems.
In this situation, it’s best practice to appoint a surveyor to inspect and create a schedule of condition. This is to prevent any unnecessary disputes at a later phase. This should be done right before you start any building works.
The neighbour dissents or they do not respond within 14 days, which means it’s presumed that they have dissented.
If this is the situation, then both parties can appoint their very own independent Party Wall Surveyor to provide a Party Wall Award.
The agreed surveyor needs to be independent and NOT the same surveyor the property owner might be using for their own works. Otherwise, their neighbour is unlikely to view the surveyor as natural.
Each owner’s appointment their own surveyor. This can be an expensive option as the homeowner carrying out the works is responsible for the cost of both surveyors.
It is important that all these options available to the neighbours are clearly explained to the neighbours when serving the Party Wall Notice.
