Details about Party Wall Awards
A party wall award is a legal document that lays out the precise rights and obligations of the constructing owner (normally, the instigator of works to be completed on the party wall) and the owner of the adjoining real estate.
An accredited party wall surveyor drafts the Party Wall Award. This is basically the case if one surveyor is appointed by all parties or draft by two surveyors if separate surveyors are assigned by both sides.
The document precisely lays out what type of construction is accomplished by the construction owner, the decided timescale and the manner of the construction works to be done.
It is actually best practice also to prepare the Schedule of Condition record as this clearly demonstrates that the building owner is responsible for any damage the party wall works may cause to the adjoining property or home.
This record works as a point of reference if any such scenario occurs. It is essential to maintain the party wall award in a safe place, preferably with the deeds to the property.
Party Wall Award also referred to as Party Wall Contract is an important legal record and will be very beneficial for virtually every future dispute resolution.
Party Wall Agreement
Before beginning any construction work in relation to party walls affecting neighbours (Adjacent Owners), a written Party Wall Agreement becomes necessary.
To be able to commence this process, the property owner that is doing the construction work has to issue a Party Wall Notice to the adjoining neighbours. This has to be delivered as a written notice.
As part of our primary expert services, we offer authorised and written Party Wall Notices all over the London area.
As soon as the Party Wall Notice has been provided, the neighbours have 14 days to respond. In this situation, there are 3 possible outcomes:
The neighbour gives assent which means accept the project to be executed offering the householder will put right any concerns.
In this case, it’s best practice to appoint a surveyor to inspect and prepare a schedule of condition. This is to avoid any unneeded disagreements at a later phase. This ought to be done right prior to starting any developing works.
The neighbour dissents or they do not answer back within 14 days, meaning it’s presumed they have dissented.
In this case, both parties can appoint their very own surveyor or even a common surveyor to issue a Party Wall Award.
The decided surveyor needs to be unbiased instead of the same surveyor the homeowner might be using for their own works. Otherwise, their neighbour is unlikely to view the surveyor as neutral.
Each owner’s appointment their own surveyor. This can be an expensive option as the homeowner carrying out the works is responsible for the cost of both surveyors.
It is important that all these options available to the neighbours are clearly explained to the neighbours when serving the Party Wall Notice.
